> ‘IS JERRY DALE AN ILLEGAL &
UNLAWFUL CANDIDATE’?
As
we approach the final days before the Primary Election here in West Virginia,
set for this coming Tuesday, 10 May 2016, it has come to our attention that Jerry Dale may
very well be in VIOLATION of the FEDERAL LAW that forbids anyone who receives
or lives off federal funds from running in a partisan political race for a
government position
– and after all, Jerry Dale is trying to recycle himself – after 20 years – to
be sheriff once again in Pocahontas County!
HEAVEN FORBID THAT OCCURS!
Currently
Jerry Dale works as an ersatz counselor for youth for an organization known as,
YOUTH HEALTH SERVICES, INC., out of Elkins,
WV, that started out as a
private-corporate nonprofit organization in 1986, but then morphed in 1989 into
a
group to provide mental health services to children ages birth to 18 years of
age that in 2009 became public school based services in Pocahontas County. From its own website:
“In 2005, Youth Health Services, Inc. responded to a growing community
need to accurately assess and treat childhood trauma. Funded by a grant from the Federal Substance Abuse
and Mental Health Services Administration, YHS’ Strength Builders Child and Adolescent Trauma
Center was establishes [sic] as part
of the U.S. National Child Traumatic Stress Network….” (Underlined for Emphasis).
Now
what makes all of this interesting is something called, THE HATCH ACT OF 1939
AS AMENDED – for under its provisions, the Hatch Act states emphatically the
following, to wit:
“The
1939 Act forbade the intimidation or bribery of voters and restricts political
campaign activities by federal employees. It prohibits using any public funds designated
for relief or public works for electoral purposes. It forbade officials paid with federal funds
from using promises of jobs, promotion, financial assistance, contracts, or any
other benefit to coerce campaign contributions or political support. It provided that persons below the
policy-making level in the executive branch of the federal government must not
only refrain from political practices that would be illegal for any citizen,
but must abstain from "any active part" in political campaigns, using
this language to specify those who are exempt:” [5]
Now
the above restricts and forbids ‘federal
employees’ from engaging in political activities in order to eliminate or
at least greatly reduce political corruption as much as possible. BUT IN 1940, the Hatch Act was amended to
include the following persons:
“An
amendment on July 19, 1940 extended the Act to certain employees of state
and local governments whose positions are primarily paid for by federal funds.
It has been interpreted to bar political activity on the part of employees of
state agencies administering federal unemployment insurance programs and
appointed local law enforcement agency officials with oversight of federal
grant funds. The Hatch Act bars state and local government employees
from running for public office if any federal funds support the
position, even if the position is funded almost entirely with local funds.” [8]
The sum result of all of this is that IF the YHS has been or
still is funded in any manner by any federal agency – then the employment of
Jerry Dale may very well prohibit him from running for ‘public office’ before first
resigning his position with YHS. IF that
is the case, then Jerry Dale might well be in violation of The Hatch Act of
1939 as amended up until now!
THUS WE ASK AGAIN:
DO THE PEOPLE OF POCAHONTAS COUNTY REALLY NEED SOMEONE LIKE JERRY
DALE IN ‘PUBLIC OFFICE’ AGAIN
– LIVING OFF
TAXPAYERS’ MONEY –
AND POTENTIALLY MAKING THE SAME MISTAKES ALL OVER AGAIN?
THIS TIME AROUND WE THINK IT’S BEST TO NOT VOTE FOR JERRY DALE…but instead…
VOTE FOR TROY McCOY
for Sheriff!
A new face is always better than recycling the same-ole,
same-ole once again!
